A wrongful death occurs as a result of the negligence of another person or party in any number of instances such as car and auto accidents, medical malpractice, boating accidents, slip and falls and defective products. When a loved one dies under circumstances that indicate a wrongful death, an attorney may seek compensation for the decedent’s surviving spouse and/or immediate family. At the Law Offices of Joseph A. Bosco, we are always on your side during these unfortunate times.
In Florida, under the Wrongful Death Act, a personal representative (PR) of the deceased must initiate a claim for wrongful death. The Florida legislature enacted the Wrongful Death Act in order to allow for recovery of damages for the death of a loved one by persons specified under the Act. Under the statute, the following persons are entitled to receive compensation in a wrongful death case under certain circumstances: Decedent’s spouse, decedent’s children, decedent’s parents, blood relatives who are dependent on the decedent for support or services.
Usually a personal representative of the deceased must initiate the wrongful death claim. If not named in the decedent’s will, or in the event the decedent left no will, generally the court will appoint the surviving spouse as the personal representative. If the decedent did not have a surviving spouse, a personal representative will be chosen by a majority vote of the decedent’s heirs. If the heirs cannot decide upon a personal representative, the court will name one.
